By booking a stay at the property, you agree to all the terms and conditions outlined in this document. ARRIVAL AND DEPARTURE: Check-in time is 4:00PM on the day of arrival. Check-out time is 11:00AM on the day of departure. Your arrival and departure date are per the final dates agreed upon by both tenant and landlord. Those dates are documented in communications between the tenant and landlord or through the booking mechanism of the website used to book the property. FEES: Fees are per the final amounts agreed upon by both tenant and landlord. That amount is documented in communications between the tenant and landlord or through the booking mechanism of the website used to book the property. A booking deposit of at least 50% of rental fee and applicable taxes is required to secure a booking at booking confirmation. The balance is due 30 days prior to check in date, or immediately upon booking, should the date of booking be less than 30 days from the date of arrival. DAMAGE AND REFUNDS: The Damage Deposit shall be processed no later than 14 days of your vacating the property, provided: • There is no damage to the property beyond normal wear and tear • There are no missing or damaged items from the property • There are no additional ‘heavy’ cleaning fees due to unreasonable mess, animals, or smoking • There are no unpaid fines imposed upon the occupants or their guests by the local authorities, HOA and/or security team for parking and other violations, etc. The tenant assumes full responsibility and accountability for ensuring that all visitors to the property, whether staying there or not, remain compliant with all the terms and conditions itemized in this document. Tenants also agree to assume full responsibility and accountability for ensuring that minors and young children also act in accordance with these terms and conditions and for any damages they may cause, as well as the safety of such minors and young children. Please find below our terms and conditions of your rental, to which you agree in order to book the property: • Once the refund is initiated, the process may take up to 7 business days to be reflected in the payment account used for the booking. The Tenant accepts that the speed with which the refund process occurs once initiated is not within the Landlord’s direct control. TERMS AND CONDITIONS: 1. The Tenants shall maintain the premises in a good, clean, and ready to rent condition, and use the premises only in a careful and lawful manner. The tenants shall leave the premises in a ready to rent condition at the expiration of the rental agreement, defined by the Landlord as being immediately habitable by the next tenants, normal cleaning withstanding. Tenant shall pay for maintenance and repairs should the premises be left in a lesser condition. The tenant agrees that the Landlord shall deduct costs of damage beyond normal wear and tear to the property or its furnishings and lack of ready to rent condition from the security deposit prior to refund. If the security deposit is insufficient to cover such damage, the Tenant shall pay any additional amounts required to restore the property to its prior habitable condition, as well as compensate for any lost rental revenue due to the lack of habitability due to such damage. The Tenant shall not remodel or in any other manner modify the property, this includes moving furniture and decor from its original location. 2. Tenants named on this agreement shall be responsible and accountable for the damages of any other individuals that stay at the property during the rental period. Disputes between Tenant regarding responsibility of damages shall be resolved between themselves. The signatory Tenants accept full responsibility for resolving all matters directly with the Landlord. If property is returned in ready to rent and habitable order, the damage/security deposit shall be refunded to the Tenant within 14 days of departure from the premises. 3. Tenant shall inform the Landlord at the earliest possible opportunity of any condition that arises on the property that either jeopardizes safety of the Tenant, or which without attention, may reasonably be seen as a risk to causing damage to the property. Examples include but are not limited to flooding, water leaks, broken glass, ‘chirping’ fire alarms, etc. 4. Tenant shall comply with local, state and federal laws, Legacy Villa by-laws and sign posted parking restrictions. Tenants accept responsibility for ensuring that citations and parking tickets issued to their vehicles and those of their guests are paid as soon as possible. Tenants agree that payment for unpaid parking tickets shall be deducted from the security deposit, along with an additional $100 administration fee and any additional fees that may be accrued due to the Tenant not paying the fines in a timely manner, or which may result from not informing the Landlord of such unpaid fines in a timely manner. Tenant agrees that they shall also be responsible for any legal fees incurred by the Landlord in order to settle unpaid citations and tickets resulting from the Tenant or the Tenant’s guests, or any costs accrued in pursuit of recovering such fines if they exceed the amount of the damage deposit. If the damage deposit has already been refunded, the Tenant agrees to pay any unpaid citations as well as a $100 administration fee, for each such citation. 5. The Landlord shall have the right to inspect the premises without prior notice at any time to enforce the terms of this agreement. Should the Tenants violate any of the terms of this agreement, the rental period shall be terminated immediately. The Tenants waive all rights to process if they fail to vacate the premises upon termination of the rental period. The Tenants shall vacate the premises at the checkout date and time granted with the original booking, unless an extension to the original booking is granted in writing, by the Landlord. 6. Tenants agree to take full responsibility for the safety of their children, and for ensuring that children are adequately supervised and to take extra precautions in ensuring their children remain safe while within the property and the gated community in general. 7. It is the tenant’s responsibility to learn about safety precautions and procedures concerning swimming in or being around the pool. Tenant agrees to have a responsible adult supervising minors while they swim in any of the pools. Supervision is MANDATORY for children under 18 years old. Tenant is hereby notified that the pools can be dangerous, and are NOT supervised lifeguards, and tenant accepts fully the risks involved for themselves and the children under their care. 8. Tenant shall ensure all towels removed from the property are returned to the property. A $20 deduction from the security deposit shall be made for each towel that is missing from the unit at the end of the rental. A $50 deduction from the security deposit shall be made if the garage door opener is missing. 9. Legacy Villas is located in a desert region. It is the tenant’s responsibility to be vigilant of natural hazards such as excessive levels of heat and potentially harmful animals. 10. Tenants shall NOT SMOKE or VAPE inside the property and shall NOT BRING PETS or animals of any kind into the property. Doing so may result in additional cleaning fees and deductions from or loss of Tenant’s security deposit. As provided for by law, service animals are permitted. Tenant acknowledges that damage or soiling by service animals may result in deductions or loss of security deposit. 11.
